Sports Mediation

Is mediation mandatory before proceeding to a formal sports tribunal?

It frequently depends on the governing body’s internal policies. Many Provincial Sport Organizations,  National Sport Organizations, as well as the Sport Dispute Resolution Centre of Canada (SDRCC) encourage, and in some cases require, parties to attempt mediation before a dispute can advance to binding arbitration or a formal hearing.

What are the strategic advantages of mediating a sports dispute instead of litigating it? 

Mediation offers speed, cost-efficiency, and confidentiality. Because the amateur and professional sports ecosystems are incredibly tight-knit, mediation also helps preserve essential relationships between athletes, coaches, and administrative bodies. 

Instead of having a rigid decision imposed by an arbitrator in a public forum, mediation allows both parties to maintain control and collaboratively shape the outcome.

Are the results of a sports mediation legally binding? 

The mediation process itself is non-binding, meaning a mediator cannot force a resolution on you or the opposing party. However, if both sides agree to settlement terms, our lawyers will draft a formal settlement agreement. Once signed, that document becomes a legally binding and enforceable contract.

Sports Adjudications

What is the Sport Dispute Resolution Centre of Canada (SDRCC)? 

The SDRCC is an independent national body that provides mediation and arbitration services specifically for amateur sports disputes in Canada. 

The organization handles high-level conflicts, such as national team selection appeals, carding (funding) disputes, and doping infractions, operating under its own highly specialized code of procedure.

How fast do sports tribunal hearings happen? 

Unlike traditional civil courts, sports tribunals operate on highly expedited timelines—especially if a dispute arises days before a major competition, tournament, or Olympic qualifier. 

Deadlines to file appeals or submit evidence are frequently measured in days or even hours rather than months, making immediate legal intervention critical to protect your right to compete.

Can I appeal the decision of a sports tribunal or the SDRCC? 

Options for appealing an arbitral award are highly restricted. SDRCC arbitration decisions, for example, are generally considered final and binding. 

In very limited circumstances, a decision can be challenged in a civil court through a judicial review (e.g., if there was a severe breach of procedural fairness or an excess of jurisdiction) or escalated to the Court of Arbitration for Sport (CAS) for certain international matters.

Sports Investigations

What should I do if I am the subject of a Safe Sport or OSIC investigation? 

If you are notified of an investigation regarding maltreatment, harassment, or a code of conduct violation, do not attempt to resolve the issue informally or speak to investigators without legal counsel. 

Secure representation immediately to ensure you receive full disclosure of the allegations against you, that confidentiality is strictly maintained, and that your procedural rights are protected throughout the interview process.

Can my sports organization suspend me while an investigation is ongoing? 

Yes, organizations frequently use interim suspensions or temporary measures while investigating serious allegations to protect participants. However, these measures must strictly follow the organization’s bylaws and procedural fairness standards. 

If an interim measure is applied improperly, punitively, or without due process, our lawyers can step in to challenge the suspension.

Who handles sports investigations in Canada? 

Depending on the level of the sport and the exact nature of the complaint, investigations may be conducted by the Office of the Sport Integrity Commissioner (OSIC) under the Universal Code of Conduct to Prevent and Address Maltreatment in Sport (UCCMS). 

Alternatively, they may be handled by independent third-party investigators hired by PSOs/NSOs, or by internal club committees. Identifying the proper jurisdiction is one of the first critical steps our legal team takes.
